- TERMS AND CONDITIONS FOR CONSENT SUBMISSION, EVENTS, AWARDS, AND PROMOTIONS
These Terms and Conditions (“Terms”) govern your submission of the collection, processing and storing of any of your personal information, materials, or content provided to SAFMA (“we,” “us,” “our”) (“including any images taken of you at such events of SAFMA) and your participation in our events and awards. By providing your personal information, submission of materials and content and / or byparticipating in our events, you consent to the collection and processing of your personal information (“including any images taken of you at such events at SAFMA) relating to such events, awards and promotions and you consent to these Terms and Conditions.
Please read each section carefully.
By providing your submission of personal information to SAFMA and/or participating in SAFMA’s events and awards (“including any images taken of you at such SAFMA events and awards) and by attending and/or participating in our SAFMA events and awards you consent to the collection, processing and storing of your personal information submitted to SAFMA relating to such events, awards and promotions. You further consent to images being taken of you at such SAFMA awards and events and consent to same being processed at such events and awards. You further give consent for the submission of such images taken at such SAFMA awards and events to be published in any national newspaper and/or any national magazine and/or on social media and you hereby acknowledge and consent to these Terms and Conditions.
- Definitions
Submission relates to:
Any text, WhatsApp, SMS, photograph, image, audio, video, data, presentation slides, posters, and/or personal information and/or other material you have provided to SAFMA.
Event Materials relates to:
any recordings, photographs, images, presentations and/or a combination of same created or shared during SAFMA-hosted events, Awards, conferences, workshops, seminars, and webinars.
Personal Information
Personal Information as defined in the Protection of Personal Information Act, Act 4 of 2013 (“POPIA”)" means information relating to any person, including but not limited to: (i) information relating to the race, gender, sex, marital status, national, ethnic or social origin, colour, age, disability, language and birth of the person; (ii) information relating to the education or the medical, financial, criminal or employment history of the person; (iii) information relating to the financial affairs of the person; (iv) credit card details and transactional data; (v) any identifying number, symbol, e-mail address, physical address, telephone number or other particular assignment to the person; (vi) correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence; (vii) the views or opinions of another individual about the person; (viii) the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person; and (ix) any other information which may be treated or defined as "personal information" in terms of any applicable Laws, including any applicable Data Protection Legislation
The Protection of Personal Information Act 4 of 2013 aims:
- to promote the protection of personal information processed by public and private bodies;
Processing
as defined in terms of POPIA, includes any operation, or activity concerning your Personal Information, including but not limited to collection, submission, storage, adaption, retrieval, disclosure, publication, or other lawful uses as defined within POPIA.
Consent to Personal Information and Data Collection and Processing
By submitting your personal information and/or data content to SAFMA or registering for SAFMA events, webinars, conferences and awards, you expressly consent to SAFMA collecting, processing and storing your Personal Information, data, images taken of you at SAFMA events, and Event Materials for these purposes. You further consent to having your images taken at such events, published in national newspaper and/or national magazine.
- Scope of Collection
We collect and process your personal information and/or data and/or material and/or attachments, images, and any metadata provided by the platform used that you supply to us within your submission forms, or at registration for our SAFMA events, awards, conferences and webinars
- Purpose of Processing
Your personal information and/or data and/or material will be processed by SAFMA to evaluate your submissions, administer awards at events, facilitate communications, and support promotional and educational activities relating to such an award and/or event and/or conference and/or webinar.
- Personal Information/Data Handling
SAFMA will store your personal information, data, images taken of you at events as well as material submitted by you, securely and shall process it in compliance with POPIA and other applicable data-protection laws. Data and/or your personal information and/or materials submitted by you will not be shared with third parties except where necessary for event administration, award publication in national newspapers and/or national magazines or where legally required to do so
Consent to Use and Publication of Submitted Content
You hereby consent to SAFMA utilising your photographs and/or images taken of you as well as your personal information and/or content related to your submission and do give your consent to SAFMA to reproduce, edit, adapt, publish and display your photographs and/or images and content related to your submission for promotional, educational, reporting, and archival purposes. You provide an undertaking that all photographs, images and content related to your submission are free from copyright.
- Online Publication
You give your consent to your personal information and/or data and content related to your submission and photographs as well as images of yourself being published on SAFMA’s official website, digital newsletters, digital national newspapers, SAFMA’s social media platforms and affiliated online portals.
- Event and Presentation Use
You give your consent to your submission content, personal information and/or data related to your submission and photographs related to your submission and taken at our events, to be published and/or to appear in SAFMA presentations, recordings, printed materials, national newspapers and national magazines and live demonstrations during SAFMA events
- Social Media and Marketing
You give your consent to SAFMA to feature the content related to your submission and photographs on platforms such as Facebook, LinkedIn, YouTube, and in marketing material.
- Attribution
We will credit you by name, title, or affiliation unless you request anonymity in writing with regards to the content related to your submission and/or your photographs taken used or submitted prior to and at the SAFMA events and or Awards
Use of Images Across Social Media Platforms and Distribution Channels
Rights Granted
You consent and grant SAFMA the consent to and the right to reproduce, distribute, and display any images (photographs, images, graphics, visual media) included in your content related to your submission or captured during SAFMA events and Awards.
Platforms and Channels
This may comprise of SAFMA’s own social media channels, SAFMA partner’s websites and social media channels, media outlets, press releases, and newsletters via email
Editing and Accessibility
SAFMA may crop, resize, enhance, or otherwise edit images and photographs of you to meet platform specifications, and may add captions, alt text, or watermarks.
Events and Awards Participation and Promotion
Event Participation
By attending a SAFMA event and/or Award, you consent to the recording, photographing broadcasting and processing of your personal information, data and material submission at any of the events and awards that you may participate in.
Event Materials Use
You consent to SAFMA having the right to reproduce and distribute any materials you provide for event and award purposes.
Awards and Recognition
If your Submission is selected for an award, you consent to SAFMA publishing your achievement through press releases, online announcements, and social media.
Publicity
You may be invited to give interviews or testimonials relating to your submission or presentation. Participation is voluntary.
No Additional Compensation
You waive any right to royalties in relation to your submission of material, photographs, images and/or presentation relating to SAFMA’s use of same event or award materials
Intellectual Property and Warranties
You warrant that:
Originality
Your content related to your submission and Event Materials, are your own original work and/or you warrant that you have obtained all necessary rights and permissions for same.
No Infringement
Use of the content related to your submission and event presentation will not violate any third-party intellectual property, privacy, or publicity rights.
Indemnity
You agree to indemnify and hold SAFMA harmless against any claims arising from your breach of these warranties.
You furthermore agree to indemnify and hold SAFMA harmless against any loss, injury, and/or damages to person and/or property that may be incurred by you at SAFMA’s conferences, events and awards.
Data Protection, Privacy, (POPIA Compliance)
SAFMA undertakes to collect and process your personal information in line with your consent that you have given freely and voluntarily in terms of these terms and conditions.
- Security Measures
SAFMA undertakes to apply reasonable technical and organisational measures to protect your personal information against unauthorised access, loss, or misuse.
- Your Rights Under POPIA
You have the right to:
Request access to your Personal Information;
Request correction or deletion of your Personal Information;
Object to the processing of your Personal Information (in which case you may not be able to attend further events, conferences and awards at SAFMA)
Lodge a complaint to the information Regulator of South Africa
Withdrawal of Consent and Removal of Content
You may withdraw your consent at any time by emailing SAFMA’S information officer and/or deputy information officer at [email protected]. Upon verification, SAFMA will remove your content from active use within a reasonable time.
Limitation of Liability
To the maximum extent permitted by South African law, SAFMA will not be liable for indirect or consequential damages, including loss of profits, data, reputation, or goodwill.
Governing Law and Jurisdiction
I acknowledge these terms and conditions, its interpretation and application will be governed by the laws of South Africa.
In the event of any dispute and/or claim arising from or in connection with these terms and conditions, or its cancellation, it shall be within the absolute discretion of SAFMA to elect whether to proceed against you in the High Court of South Africa or a Magistrate’s Court with competent jurisdiction, or by way of arbitration.
If SAFMA in its sole discretion elects to refer the dispute to arbitration, then such dispute shall be either:
Resolved in accordance with the expedited rules of the Arbitration Foundation of Southern Africa (“AFSA”) by an arbitrator appointed by AFSA and all proceedings will be held in Sandton, Gauteng;
The method and procedure to be followed in the arbitration shall be that as stipulated by the arbitrator, it being recorded that it is the intention of the parties that the arbitration shall be held informally in order to arrive at a decision as expeditiously and inexpensively as possible, AFSA’s “Expedited rules” will apply. Save as aforesaid the remaining provisions of the Act shall apply.
Any party shall have the right to apply at their cost, to make the arbitration award an order of court.
- All proceedings will be held in Sandton, Gauteng.
In the event of SAFMA instituting any legal proceedings of whatsoever nature and in whatsoever forum against you, you will be liable for all costs incurred by SAFMA on the scale as between attorney-and-own-client.
Acceptance of Terms
by purchasing or receiving a ticket/tickets (complementary ticket/Tickets included) and registering for an event, award, conference and/or webinar and/or submitting content, personal information and images of yourself in your submission, you confirm that:
You have read, understood, consented too and accepted these Terms and Conditions.
You are at least 18 years old and legally capable of entering into this agreement.
