Ticket Terms & Conditions, Participation Agreement and Indemnity

Event Date: Saturday, 31 October 2026

Venue: Tafelberg School, Bothasig


By purchasing a ticket through Quicket, accepting a complimentary ticket, or entering the Tafelberg School Family Day ("the Event"), you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.


1. Definitions

For the purposes of these Terms & Conditions:

  • "Event" means the Tafelberg School Family Day, including all activities, attractions, entertainment, Cape Kaskar races, inflatable play areas, market stalls, food vendors and associated activities.
  • "Venue" means Tafelberg School, Bothasig.
  • "Organiser" means the Tafelberg School Parent Teacher Association (PTA), acting in support of Tafelberg School.
  • "Ticket Holder", "Attendee", "Participant" or "You" means any person holding a valid ticket or entering the Event.
  • "Minor" means any person under the age of eighteen (18) years.
  • "Operators" means Cape Kaskar, Rumble Grumble, the appointed Security Company, contractors, exhibitors, vendors, volunteers, emergency service providers and all other third-party service providers engaged by the Organiser for the Event..


2. Ticket Purchase & Validity

  • Each ticket grants the holder a revocable licence to attend the Event.
  • Tickets are valid only if purchased through Quicket or another authorised sales channel approved by the Organiser.
  • Tickets may not be altered, duplicated or resold for commercial gain.
  • The Organiser reserves the right to refuse admission where tickets are fraudulent, duplicated, altered or otherwise invalid.
  • Tickets remain the property of the Organiser until the conclusion of the Event.
  • Certain activities may require separate tickets or wristbands.


3. Entry Requirements

  • A valid ticket must be presented upon request.
  • Right of Admission Reserved (ROAR).
  • All persons and their belongings may be searched upon entry.
  • The Organiser reserves the right to refuse admission or remove any person without refund for:
  • intoxication;
  • possession or use of illegal substances;
  • violent, abusive, threatening or disruptive behaviour;
  • refusal to comply with security procedures;
  • failure to comply with these Terms & Conditions or any safety instructions.


4. Participation & Parent Responsibility

  • Participation in all activities is entirely voluntary.
  • Parents and legal guardians are responsible for ensuring that children participate only in activities suitable for their age, size and physical ability.
  • Children under the age of twelve (12) years must be accompanied and supervised by a responsible adult at all times while attending the Event, except when participating in an authorised activity under the direct supervision of the appointed operator or activity supervisors.
  • Parents and legal guardians remain responsible for the behaviour, supervision and welfare of all minors attending the Event.
  • Participants must comply with all lawful instructions issued by Event Officials, appointed Security Company Staff, volunteers, attraction operators, emergency services and authorised representatives of the Organiser.
  • Any participant who behaves in an unsafe manner or fails to follow instructions may be removed from an activity or from the Event without refund.


Lost Children

  • The Organiser will make reasonable efforts to reunite lost children with their parent or legal guardian.
  • Parents and guardians remain responsible for the supervision of their children at all times.
  • Parents are strongly encouraged to ensure that children wear an identification wristband displaying the contact details of a parent or guardian.
  • Tafelberg School, the PTA, volunteers and Event officials shall not be liable for any loss, injury or damages arising from a child becoming separated from their parent or guardian, except where caused by gross negligence or wilful misconduct.


5. Security & Prohibited Items

For the safety and security of all attendees, the Organiser has appointed a professional Security Company to provide access control, crowd management, patrols and emergency response services throughout the Event.

Security Company Staff are authorised to conduct bag searches, monitor prohibited items, enforce these Terms & Conditions, manage crowd movement, assist with emergency evacuations and remove persons whose conduct presents a safety or security risk.

For the safety of all attendees:

The following items are prohibited:

  • firearms, knives or weapons;
  • fireworks or explosives;
  • illegal substances;
  • dangerous objects or glass containers;
  • drones without prior written approval;
  • noise-making devices including loudhailers and vuvuzelas;
  • items intended for unauthorised sale or promotion.

The Organiser reserves the right to confiscate prohibited items, deny entry or remove persons found in possession of prohibited items.


6. Health & Safety

  • Participants should not take part in physical activities if they suffer from any medical condition that could place themselves or others at risk.
  • Participation is not recommended for persons who are pregnant or who suffer from serious heart, neck, back or mobility conditions.
  • Appropriate clothing and footwear should be worn when participating in activities.
  • Smoking or vaping is permitted only in designated smoking areas.
  • In the event of an emergency or evacuation, all attendees must immediately comply with instructions issued by Event Officials, appointed Security Company Staff, Emergency Medical Services, Fire & Rescue personnel or the South African Police Service where applicable.

Medical Assistance

Should a participant require emergency medical attention, the Organiser will make reasonable efforts to obtain appropriate medical assistance. Any costs associated with medical treatment or transportation shall remain the responsibility of the participant or their parent or legal guardian.


First Aid

The Organiser will make reasonable efforts to ensure that qualified First Aid personnel and first aid facilities are available during the Event.

Attendees acknowledge that the provision of First Aid is intended only for the initial treatment of minor injuries and emergency stabilisation where appropriate. First Aid services do not replace professional emergency medical services, hospital treatment or ongoing medical care.

The Organiser, Tafelberg School, the PTA, appointed Security Company Staff and First Aid personnel shall not be liable for any medical outcome arising from the provision or non-provision of First Aid, except where caused by gross negligence or wilful misconduct.


7. Emergency Evacuation

In the event of an emergency requiring evacuation of the Venue, all attendees must immediately follow the directions of Event Officials, appointed Security Company Staff, Emergency Medical Services, Fire & Rescue personnel or any other authorised emergency responder. Failure to comply with evacuation instructions may result in removal from the Event and may place the attendee and others at unnecessary risk.


8. Cape Kaskar Go-Kart Activities

Participation in Cape Kaskar activities is voluntary and undertaken entirely at the participant's own risk.

Participants acknowledge that go-kart racing involves inherent risks, including but not limited to:

  • collisions;
  • falls;
  • overturning;
  • loss of control;
  • contact with barriers or other participants;
  • damage to personal property;
  • serious injury or death.

Participants agree to:

  • obey all instructions issued by Cape Kaskar officials and marshals;
  • wear all required safety equipment correctly;
  • operate the go-karts responsibly and safely.

Any participant behaving recklessly or failing to comply with instructions may be removed immediately from the activity without refund.

Parents and legal guardians are responsible for determining whether their child is physically capable of safely participating.


9. Rumble Grumble Inflatable Attractions

Participation in inflatable activities is voluntary and undertaken entirely at the participant's own risk.

Participants acknowledge that inflatable attractions involve inherent risks including falls, collisions and accidental injuries.

Participants agree that:

  • children may only use inflatables appropriate to their age and size;
  • shoes, food, drinks, chewing gum and sharp objects are prohibited on inflatables;
  • all instructions issued by Rumble Grumble supervisors must be followed;
  • parents remain responsible for supervising children before entering and immediately after exiting the attraction.

Failure to comply with safety rules may result in removal from the attraction.

10. General Indemnity

To the fullest extent permitted by the laws of the Republic of South Africa, each attendee, participant, parent or legal guardian, on behalf of themselves and any minor in their care, hereby releases, waives and indemnifies Tafelberg School, the School Governing Body, the Tafelberg School PTA, Cape Kaskar, Rumble Grumble, sponsors, exhibitors, vendors, volunteers, contractors, employees, appointed Security Company Staff, officials, emergency responders, service providers and agents against any claim, liability, loss, damage, injury, illness or death arising directly or indirectly from attendance at or participation in the Event, except where such loss or injury results from gross negligence or wilful misconduct.

This indemnity includes, but is not limited to:

  • Cape Kaskar activities;
  • inflatable attractions;
  • playground equipment;
  • obstacle activities;
  • entertainment;
  • food and beverage vendors;
  • market stalls;
  • parking areas;
  • pedestrian walkways;
  • queues;
  • all other attractions and facilities associated with the Event.

The acknowledgements contained in Section 10 – Assumption of Risk form an integral part of this Indemnity and are incorporated herein by reference. Attendance and participation constitute acceptance of those risks.


11. Assumption of Risk

Participation in the Event is entirely voluntary.

By attending the Event, each attendee, participant, parent or legal guardian acknowledges and accepts that participation in a large outdoor family event involves inherent and unavoidable risks, including but not limited to:

  • slips, trips and falls;
  • collisions with other participants or objects;
  • injuries sustained while participating in recreational activities;
  • equipment malfunction or misuse;
  • changing weather conditions;
  • uneven surfaces or natural hazards;
  • crowd movement;
  • participation in Cape Kaskar activities;
  • participation in inflatable attractions;
  • food purchased from independent vendors;
  • vehicle movement within parking areas;
  • any other activities ordinarily associated with a public outdoor event.

Each attendee acknowledges that these risks cannot be completely eliminated despite reasonable safety measures implemented by the Organiser.

Attendance and participation constitute acceptance of these inherent risks.


12. Liability Disclaimer

Attendance at the Event is entirely at your own risk.

To the fullest extent permitted by law, the Organiser accepts no liability for:

  • loss, theft or damage to personal property;
  • injury arising from participation in Event activities;
  • vehicle theft or damage;
  • parking, traffic or access delays;
  • services or products supplied by third-party vendors;
  • interruptions caused by weather or circumstances beyond the Organiser's reasonable control.
  • actions reasonably taken by appointed Security Company Staff while carrying out their duties in maintaining the safety and security of the Event, except where such actions constitute gross negligence or wilful misconduct.

Nothing contained herein excludes liability for gross negligence or wilful misconduct where such exclusion is prohibited by law.

Attendees are solely responsible for their personal belongings, and the Organiser accepts no responsibility for lost, stolen or damaged property.


Food & Allergies

Food and beverages sold during the Event are supplied by independent vendors.

The Organiser, Tafelberg School and the PTA make no warranties regarding ingredients, preparation methods or allergens contained in food or beverages supplied by third-party vendors.

Attendees with food allergies or dietary requirements are solely responsible for making appropriate enquiries with the relevant vendor before consuming any food or beverages.

The Organiser accepts no liability for allergic reactions, food poisoning or any illness arising from food or beverages purchased from independent vendors.


Parking

Parking is provided, where available, solely as a convenience to attendees.

All vehicles and their contents are parked entirely at the owner's risk.

The Organiser, Tafelberg School, the PTA, appointed Security Company Staff and volunteers accept no responsibility for theft, damage or loss involving any vehicle or its contents.

Animals

No animals shall be permitted within the Event venue unless:

  • they are recognised assistance or service animals accompanying a person with a disability; or
  • prior written authorisation has been granted by the Organiser.

Owners remain fully responsible for the conduct and control of any authorised animal while attending the Event.


13. Event Changes, Weather, Cancellation & Refunds

  • The Organiser reserves the right to amend the programme, attractions or schedule without prior notice.
  • Certain attractions, including Cape Kaskar activities, inflatable attractions and other outdoor activities, may be delayed, suspended or cancelled where weather conditions or other safety considerations require such action.
  • The Event may be postponed or cancelled due to severe weather, emergencies or circumstances beyond the Organiser's reasonable control.
  • Should the Event be cancelled in its entirety, ticket holders will be entitled to a refund of the ticket face value in accordance with applicable legislation and Quicket's refund procedures.
  • If the Event is postponed, tickets will remain valid for the rescheduled date unless otherwise advised.
  • No refunds will be issued for no-shows, late arrivals or the temporary closure of individual attractions due to safety considerations.


Force Majeure

The Organiser shall not be liable for any delay, interruption, postponement, alteration or cancellation of the Event arising from circumstances beyond its reasonable control, including but not limited to:

  • severe weather;
  • flooding;
  • fire;
  • acts of God;
  • civil unrest;
  • riots;
  • strikes;
  • pandemics;
  • government restrictions;
  • power failures;
  • failure of essential services;
  • acts of terrorism; or
  • any other event rendering the Event unsafe or impracticable.

Where reasonably possible, the Organiser will notify ticket holders of any material changes to the Event.


14. Behaviour & Conduct

Attendees are expected to conduct themselves in a respectful and responsible manner at all times.

Any person who:

  • threatens the safety or wellbeing of others;
  • behaves abusively or aggressively;
  • damages property;
  • fails to comply with lawful instructions issued by Event Officials, appointed Security Company Staff, emergency personnel or attraction operators.

may be denied entry to, or removed from, the Venue by the Organiser or appointed Security Company Staff without refund. Where appropriate, serious incidents may be reported to the South African Police Service.


15. Photography, Video & Media

Photographs, video recordings and other media may be captured throughout the Event.

By attending the Event, attendees consent to the use of such images or recordings by Tafelberg School and the PTA for educational, promotional, fundraising and marketing purposes without compensation.

Persons who do not wish to appear in photographs should notify the Organiser before entering the Event.


16. Privacy (POPIA)

Personal information collected through Quicket or directly by the Organiser will be processed in accordance with the Protection of Personal Information Act, 2013 (POPIA).

Information will be used solely for the administration and management of the Event and will not be disclosed except where required by law or for legitimate Event administration purposes.


17. Governing Law and Severability

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Should any provision of these Terms & Conditions be declared unlawful, invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed only to the extent necessary, and the remaining provisions shall remain in full force and effect.

No failure or delay by the Organiser to enforce any provision of these Terms & Conditions shall constitute a waiver of any rights.

These Terms & Conditions constitute the entire agreement between the Organiser and the Ticket Holder concerning attendance at the Event and supersede any previous communications relating to the Event.


18. Acceptance

By purchasing a ticket through Quicket, accepting a complimentary ticket, or entering the Event, each attendee confirms that they have read, understood and accepted these Terms & Conditions in full.

Where a ticket is purchased on behalf of another person or a minor, the purchaser confirms that they are authorised to accept these Terms & Conditions on behalf of that person and, where applicable, consents to the participation of the minor under these Terms & Conditions.
