CRINKLY WATERFALL HERITAGE DAY POOL OPEN DAY – INDEMNITY & TERMS AND CONDITIONS

IMPORTANT NOTICE

Please read these Terms and Conditions and Indemnity carefully before purchasing your ticket.

By purchasing a ticket and/or attending the Heritage Day Pool Open Day, you confirm that you have read, understood and agree to these Terms and Conditions and Indemnity.

1. ATTENDANCE & ASSUMPTION OF RISK

I acknowledge that attendance at an outdoor event and participation in activities at the venue involves inherent risks. These may include, but are not limited to, slips, trips, falls, uneven surfaces, wet surfaces, swimming and water-related incidents, drowning, injuries arising from recreational activities, heat, weather conditions, fire, charcoal, braai facilities, hot surfaces, food preparation and other risks associated with an outdoor venue.

I voluntarily accept these risks and agree to take reasonable care of myself and those in my care.

2. SWIMMING POOL

The swimming pool at Crinkly Waterfall is not normally open for public use and is being made available specifically for this Heritage Day event.

Use of the swimming pool and surrounding pool area is entirely at the attendee's own risk.

Swimming ability is the responsibility of each individual. Guests must behave responsibly and must not engage in dangerous, reckless or inappropriate behaviour in or around the pool.

No running, pushing, diving where prohibited, fighting or other unsafe behaviour will be permitted.

Crinkly Waterfall reserves the right to restrict or prohibit any person's use of the pool where management or staff reasonably believe that the person's behaviour is unsafe.

3. CHILDREN & MINORS

Parents, guardians and responsible adults remain responsible for the supervision, behaviour and safety of children and minors in their care at all times.

Children and minors must not be left unattended anywhere on the property, particularly in or around the swimming pool, braai facilities or other areas presenting potential hazards.

The purchase of a children's ticket does not transfer responsibility for supervision to Crinkly Waterfall or its staff.

4. BRAAI & FIRE SAFETY

Braai facilities are provided for guests to use at their own risk.

Guests acknowledge the risks associated with open flames, fire, charcoal, smoke, hot surfaces, cooking equipment and food preparation.

Braais must be used responsibly and only for their intended purpose.

Children must be kept away from braais, hot surfaces, flames and charcoal.

Guests must follow all safety instructions given by Crinkly Waterfall management or staff.

Crinkly Waterfall may require a braai to be stopped or made safe where it considers the use to be dangerous.

5. FOOD & PICNIC

Guests attending the Bring & Braai may bring their own food and picnic items as permitted by the event rules.

Guests are responsible for the safe handling, preparation, storage and consumption of their own food.

Crinkly Waterfall cannot accept responsibility for illness, allergic reactions, food poisoning or other consequences arising from food brought onto the property or food prepared or consumed by guests.

Guests with food allergies or specific dietary requirements are responsible for taking appropriate precautions.

6. DRINKS POLICY

No external drinks may be brought onto the property.

Drinks are available for purchase from the venue.

Guests must comply with all venue rules relating to the purchase, possession and consumption of beverages.

7. GLASS & POOL AREA

No glass is permitted in the pool area.

Guests must ensure that bottles, glasses and other breakable items are kept away from the pool area.

Any broken glass or other hazardous material must be reported to venue staff immediately.

8. VENUE RULES & STAFF INSTRUCTIONS

All guests must comply with the reasonable rules and safety instructions of Crinkly Waterfall management and staff.

Management reserves the right to refuse or terminate access to any area of the venue, including the swimming pool, where a guest behaves in an unsafe, disruptive, abusive or inappropriate manner.

No guest may interfere with venue equipment, facilities, safety equipment or property.

9. PERSONAL BELONGINGS

Guests are responsible for their own personal belongings, valuables, clothing, phones, wallets, bags, swimming equipment and other property.

Crinkly Waterfall does not accept responsibility for loss, theft or damage to personal belongings brought onto the property, except where liability cannot lawfully be excluded.

10. WEATHER & OUTDOOR CONDITIONS

This is an outdoor event and weather conditions may affect the use of the pool, braai areas or other facilities.

Guests acknowledge that exposure to sun, heat, rain, wind, slippery surfaces and other weather-related conditions may create risks.

Crinkly Waterfall reserves the right to alter, restrict, postpone or cancel activities where reasonably necessary due to weather, safety concerns, operational requirements or circumstances beyond the venue's reasonable control.

11. EMERGENCIES & MEDICAL ASSISTANCE

In the event of an accident, injury or medical emergency, Crinkly Waterfall staff may contact emergency medical services or provide reasonable assistance where appropriate.

Guests are responsible for providing accurate emergency and medical information where requested.

Any medical, ambulance, hospital or other emergency costs incurred by an attendee remain the responsibility of the attendee or their parent/guardian, as applicable, unless otherwise required by law.

12. ALCOHOL & RESPONSIBLE BEHAVIOUR

Guests must behave responsibly and must not participate in activities while impaired in a manner that creates a danger to themselves or others.

Crinkly Waterfall reserves the right to refuse service or require a guest to leave the premises where their behaviour is unsafe, aggressive, abusive, disruptive or otherwise inappropriate.

13. DAMAGE TO PROPERTY

Guests are responsible for damage caused to Crinkly Waterfall property, equipment or facilities as a result of their intentional, reckless or negligent conduct, to the extent permitted by law.

14. INDEMNITY & LIABILITY

To the fullest extent permitted by South African law, I accept responsibility for the risks associated with my attendance and participation in the event and agree to indemnify and hold harmless Crinkly Waterfall, its owners, management, employees and authorised representatives against claims, losses, damages, costs or expenses arising from my own acts, omissions or participation in the event, except where such liability cannot lawfully be excluded or limited.

Nothing in these Terms and Conditions is intended to exclude or limit any liability, right or remedy that cannot lawfully be excluded or limited under applicable South African law.

15. RESPONSIBILITY FOR PERSONS IN MY CARE

Where I purchase a ticket for or attend the event with a child or minor, I confirm that I am responsible for that child or minor and accept responsibility for ensuring that they comply with these Terms and Conditions and all venue rules.

16. REMOVAL FROM THE VENUE

Crinkly Waterfall reserves the right to require any person to leave the property where that person's behaviour is dangerous, unlawful, abusive, disruptive or in breach of these Terms and Conditions or venue rules.

No refund will necessarily be provided where a guest is removed from the venue due to their own misconduct, subject to applicable law.

17. EVENT CHANGES

Crinkly Waterfall reserves the right to make reasonable changes to the event, facilities, activities, operating arrangements or access to particular areas where necessary for safety, weather, operational or other reasonable circumstances.

18. ACCEPTANCE

By purchasing this ticket and attending the event, I confirm that:

• I have read and understood these Terms and Conditions and Indemnity.

• I understand that swimming and outdoor activities involve inherent risks.

• I understand that the pool is being opened specifically for this event and is not normally open for public use.

• I agree to follow all venue rules and staff instructions.

• I accept responsibility for myself and, where applicable, for children or minors in my care.

• I voluntarily accept the risks associated with attending and participating in the event.

IMPORTANT:

Participation in the Heritage Day Pool Open Day, including use of the swimming pool, braai facilities and outdoor areas, is undertaken at the attendee's own risk, subject always to rights and liabilities that cannot lawfully be excluded or limited under South African law.
