FIC INSPECTION

  • Inspection in terms of section 45B of the Financial Intelligence Centre Act 38 of 2001 (the FIC Act)
  • Information to be submitted (RMCP & Forms)
  • Documentation to be submitted (RMCP & Forms)
  • Inspection Questionnaire (8 Compliance obligations)
  • Preliminary inspection findings/report
  • Final inspection findings/report
  • Required remedial action
  • Non-compliance
  • Actions or omissions that may lead to criminal prosecution and/or an administrative sanction
  • Object to the inspection

PPRA INSPECTION on PPA/PPR/FIC and Code of Conduct

  • By the Property Practitioners Regulatory Authority (PPRA) to conduct an inspection in terms of section 25(2) of the Property Practitioners Act, 22 of 2019 (the PP Act).
  • Compliance or non-compliance of PPA & PPR (and Code of Conduct)
  • Documentation to be available/accessible
  • Employees and management to be present
  • Minor Compliance Notice - remedy and/or fine
  • Substantial contraventions notice - Notice of Adjudication - You will have to appear before an Independent Adjudicator who has the authority to adjudicate the dispute so formulated by the PPRA.

  • Sanctionable Conduct
