The Constitutional Court of South Africa recently made a ground-breaking ruling that the parental leave provisions under the Basic Conditions of Employment Act (BCEA) and Unemployment Insurance Fund Act (UIF Act) are unconstitutional. The judgment in Van Wyk and Others vs Minister of Employment and Labour and Others affirms that all parents, regardless of gender or type of parenthood, must be entitled to equal parental leave.
The Constitutional Court has granted equal parental leave for all parents. Following the 03rd October 2025 Constitutional Court judgment, South African employers are now legally compelled to implement the latest parental leave provisions in line with constitutional rights to equality, dignity, and fair labour practices. This landmark ruling has far-reaching implications for employers, from updating parental leave policies to ensuring compliance and avoiding discrimination.
