FOCUS ON: FICA and PPRA inspection readiness


VIRTUAL INSPECTION (FICA)

  1. Inspection in terms of section 45B of the Financial Intelligence Centre Act 38 of 2001 (the FIC Act)
  2. Information to be submitted (RMCP & Forms)
  3. Documentation to be submitted (RMCP & Forms)
  4. Inspection Questionnaire (7 Compliance obligations)
  5. Preliminary inspection findings/report
  6. Final inspection findings/report
  7. Required remedial action
  8. Non-compliance
  9. Actions or omissions that may lead to criminal prosecution and/or an administrative sanction
  10. Object to the inspection


VIRTUAL INSPECTION (PPA/PPR)

  1. By Property Practitioners Regulatory Authority (PPRA) to conduct an inspection in terms of section 25(2) of the Property Practitioners Act, 22 of 2019 (the PP Act).
  2. Compliance or non-compliance of PPA & PPR (and Code of Conduct)
  3. Documentation to be available/accessible
  4. Employees and management to be present
  5. Minor Compliance Notice - remedy and/or fine
  6. Substantial contraventions notice - Notice of Adjudication - You will have to appear before an Independent Adjudicator who has authority to adjudicate the dispute so formulated by the PPRA.
  7. Non-compliance
  8. Sanctionable Conduct
