SUMMARY:
In this Webinar, Carl Liebetrau – a Senior Associate of SBL Inc. – will unpack the recent judgment of the Supreme Court of Appeal, wherein it was confirmed that Section 14 of the Consumer Protection Act is applicable to almost all residential lease agreements operating in the fixed term. Moreover, Carl will discuss the interplay between ‘cancelling’ a lease agreement on the basis of a breach and ‘terminating’ a lease agreement for a reason which does not constitute an unfair practice, is clearly stipulated in the lease agreement and agreed to by the tenant, such as in the event that the property is sold by the landlord during the fixed term to a new owner. Finally, Carl will discuss the tenant’s right to cancel a lease agreement early in terms of the Consumer Protection Act and discuss what constitutes a ‘reasonable cancellation penalty’.
