The framework for thinking about child protection is rooted in a Child Rights culture, where children must be kept safe in order to develop optimally. South Africa is a signatory to a variety of international policies that guide how we think about the rights of children. These have then been enshrined in our Constitution as indelible rights that ensure the Best Interests of the Child.
The give effect to these rights there are a variety of laws relating to children that must be understood by everyone who works with children. This is our Duty of Care and broadly falls into two categories, a negative duty (do not harm children) and a positive duty to actively protect children. The laws cover both children who are victims of abuse ande deliberate neglect, as well as those who have victimised others. These involve the concepts of consent and capacity.
In discharging our positive duty to actively protect children, professionals are required, under two pieces of legislation, to report abuse and deliberate neglect to State authorities. Failure to do so constitutes an offence. There are protocols for reporting and systems that need to be activated in these cases.
This talk will address the above, with illustrative case examples, to make the training practical and applicable. Participants will also be able to ask questions and interact with the material.
