IEASA invites you to a Rental MasterClass Webinar by Shaun Luyt on the "New" Draft Rental Regulations.


The Minister for Human Settlements gazetted a draft of the new rental housing regulations on 18 March 2022. These regulations are open for public comment for 60 days from the date of the gazette.


THE NEW DRAFT RENTAL REGULATIONS, IN THEIR CURRENT FORM, WILL AFFECT YOUR BUSINESS - INCLUDING FINANCIALLY!

 

Be prepared! Be proactive! You can make a change by submitting your comments in the allotted timeframe for comments!

 

Here are some of the changes . . .

 

- “goods” means movable goods of any description; and includes animals and plants; and also includes money, documents, and all other things of value


- The lease agreement shall comply substantially with the agreement attached to the Regulations as Schedule 4-Pro-forma Lease Agreement

 

- The landowner shall not be permitted to levy any charge for the preparation and drafting of a lease agreement unless such charge represents an actual disbursement incurred by the landowner

 

- No charge may be levied by the landowner for a lease that is being renewed or extended

 

- the lease will terminate on the day that the landowner becomes aware of the death of a sole tenant

 

- Ingoing and outgoing Inspections are to be completed with the tenant present and must be reduced to writing. No inspection fee may be charged by either party;

 

-The lease agreement in the English language must be signed by the parties together with a corresponding version in the official language of the tenant’s choice, if any
