ABOUT

Join INSTOPP for a Webinar on Labour-related matters to consider when dealing with employees who have performance difficulties, presented by Peter Strasheim (Disability and Human Rights lawyer).

OTs who consult or make recommendations at workplaces need to be able to identify and facilitate solutions that will benefit the disabled employee and their employer.

To be able to do these effectively in the interests of all it is vital to:

Know the different types of workplace difficulties:

- conduct and misconduct

- work and poor performance

- health and ill-health / injury

Recognise which type of difficulty seems to be involved

Identify whether a disability is / may be the cause of the difficulty

Match the OT recommendation to:

- the medical facts / reports

- the difficulty

Understand the role of reasonable accommodation (RA) in supporting employee performance

Promote the employee's right to RAs

Promote the employer's duty to provide RAs

Write reports that will:

- refer to the RA right and duty

- make effective RA recommendations that are not unreasonable or unjustifiably hard to implement

- demonstrate that the RA will not likely to be unjustifiably hard for the employer to provide

- support both the employee'd performance and the employer's need for productivity

Know what to do if a medical recommendation is ignored

Know when to suggest to the employee / family / HR to consider:

- a COIDA claim

- a UIF Sickness Benefit

- an application for an insured disability benefit

- a claim on a private policy of insurance
